Tenancy deposit protection applies to all deposits for assured short-hold tenancies that started in England or Wales on or after 6 April 2007. Most residential tenancies in the private rented sector are assured short-hold tenancies, with some exceptions. For example, a tenancy cannot be an assured short-hold tenancy if: l the tenant is a company; l the rent is more than £100,000 a year; l the tenancy is for a holiday let; or l a university or college rents the accommodation to its students.
It is the responsibility of the Landlord or Agent to make sure tenant deposits are secured with a tenancy deposit scheme. Failure to do so could result in legal proceedings.
That is why Kentwood have registered with the TDS. The TDS is the longest serving government approved scheme protecting millions of deposits every year. We use the TDS custodial service which means deposits are held with the TDS. At the end of the tenancy the TDS will return the deposits to you, or your tenant if there are no disputes about the condition of the property. If there are the TDS will adjudicate these disputes and decide how to resolve the issues both you or your tenant may have.
